Terms of Service

Dr Tess of Beverly Hills/Virtual Concierge MD

Theressia L. Washington, MD, P.C.

Effective September 2, 2026 | Supersedes July 3, 2025

1. Agreement

By using our websites, booking a visit, or receiving services, you agree to these Terms. If you do not agree, do not use our services.

Services are provided by Theressia L. Washington, MD, P.C., a California professional corporation.

2. Eligibility

You must be 18 or older, or have a parent or guardian consent on your behalf, and be physically located in California, Illinois, Indiana, Montana, Nevada, or New York at the time of each visit. You must confirm your location at every visit.

You need a device with a working camera and microphone, a reliable connection, a private location, and a valid email address and phone number.

3. Your Account

Provide accurate information and keep it current. Do not share your login credentials. You are responsible for activity under your account. Tell us immediately if you suspect unauthorized access.

We may require identity verification.

4. Medical Services

A physician-patient relationship begins when you register, complete informed consent, are accepted as a patient, and have a clinical encounter. Browsing our site or contacting us does not create one.

Care is provided at the same professional standard as in-person care. Your physician exercises independent clinical judgment and may decline to prescribe, may recommend a different treatment than you requested, or may refer you for in-person evaluation.

Booking any visit does not guarantee any prescription.

5. Appointments

Confirmed at booking. Cancellation terms are in our Refund Policy. We are not an emergency service and do not provide 24/7 coverage.

6. Payment

We do not bill insurance. Payment is due at the time of service. Medications, laboratory testing, imaging, and supplements are billed separately by third parties.

Recurring memberships renew automatically until cancelled — see Subscription & Auto-Renewal Terms. You have the right to a Good Faith Estimate.

Unpaid balances may be referred for collection as permitted by law.

7. Prescriptions

Issued only after individualized evaluation and only when medically appropriate. Sent electronically to the pharmacy you choose. Subject to state law and, for controlled substances, to DEA requirements and a separate Controlled Substance Agreement.

8. Privacy

Governed by our Notice of Privacy Practices. Website data collection is described in our Privacy Policy. Nevada residents should also see our Consumer Health Data Privacy Notice.

We use more than one electronic health record platform. Your complete record includes information from every system in which you receive care.

9. Prohibited Conduct

Do not misrepresent your identity or location, share your account, obtain prescriptions by deception, resell or divert medication, harass staff, record a visit without consent, attempt unauthorized access, or use our content to train AI systems.

Violations may result in termination of services without refund and, where appropriate, reporting to authorities.

10. Artificial Intelligence

Where generative AI drafts a patient communication containing clinical information not reviewed by a licensed clinician before sending, it is labeled as AI-generated with instructions for reaching a human clinician. AI is never used for clinical decisions, treatment planning, or therapy.

11. Disclaimers

Our websites and platforms are provided as-is. We do not warrant uninterrupted or error-free operation. No treatment outcome is guaranteed.

12. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages arising from use of our websites or platforms, technical failures, or third-party services.

Nothing in these Terms limits liability for professional negligence in the delivery of medical care, and nothing here waives any right you have under law.

13. Termination

You may stop using our services at any time. If you are taking a prescribed medication, contact us so we can arrange safe continuation, tapering, or transfer. Do not stop medication abruptly because of a billing or account issue.

We may terminate for non-payment, violation of these Terms, or where the physician-patient relationship is no longer clinically appropriate. Where we terminate, we will provide reasonable notice, a safe transition plan, and referral where appropriate, consistent with our professional obligations.

Your records are retained as law requires and remain available to you.

14. Changes

We may update these Terms. Material changes will be posted with a revised effective date. Continued use after changes constitutes acceptance.

15. Governing Law

California law governs, without regard to conflict-of-law principles. Where a separate arbitration agreement has been signed, it controls dispute resolution to the extent enforceable.
