SMS Privacy Statement

What This Covers

This statement explains how we collect, use, and protect information in connection with our text messaging service. It applies to everyone who receives text messages from us.

Information We Collect

  1. Your name
  2. Your mobile phone number
  3. Consent records — the date, time, and method by which you opted in
  4. Message logs — messages sent, delivery status, and opt-out requests

We do not collect the content of messages you send to other people, your location, or your contacts.

How We Use It

To deliver the messages you consented to receive, to maintain proof of consent as the law requires, to honor opt-out requests, and to monitor service reliability.

Who We Share It With

We share your name and mobile number with the messaging vendor that transmits messages on our behalf, under a written agreement requiring them to protect your information and use it only as we direct.

We do not sell your mobile phone number or your message data.

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third party except the subcontractors that deliver the messaging service.

We may disclose information as required by law, in response to lawful process, or to protect health or safety.

Message Frequency and Cost

Up to 10 messages per month. Frequency varies with your care needs and appointments.

Message and data rates may apply. We do not charge you for messages; your mobile carrier may.

Messages are sent between 8:00 AM and 9:00 PM local time, except for appointment-day reminders and urgent care-related notifications.

How to Stop Messages

  1. Reply STOP to any message. You will receive one confirmation and no further messages from that program.
  2. Reply HELP for information.
  3. Reply START to resume.
  4. Or call 1(310) 275-8377 or email privacy@virtualconciergemd.com.

You may revoke consent by any reasonable means, not only by replying STOP. We honor opt-outs promptly and no later than ten business days.

Opting out does not affect your medical care. We will reach you by phone, portal, or mail instead.

Health Information and HIPAA

Text messages that contain your protected health information are governed by our Notice of Privacy Practices.

Text messaging is not a secure channel. We limit clinical content in text messages to the minimum necessary. Use the secure patient portal for anything detailed.

What Text Is Not For

Medical emergency — call 911.

Mental health crisis — call or text 988.

Do not use text to report urgent symptoms or request urgent medication changes. Do not send Social Security numbers, full payment card numbers, or passwords.

Retention

We retain consent records, message logs, and opt-out requests for at least four years. You may request a copy of your consent record.

Minors

We do not send messages to patients under 13. For minor patients, consent is provided by a parent or guardian, subject to state law on adolescent confidentiality.

Compliance

Our messaging practices are designed to comply with the Telephone Consumer Protection Act and FCC rules, HIPAA, applicable state law in California, Illinois, Indiana, Montana, Nevada, and New York, and mobile carrier and industry messaging standards.

Changes

We may update this statement. The current version is posted at our Legal Center with a revised effective date.
